I am filing taxes for a deceased person and I am being told I cannot e-file because a federal refund is involved. What do I do now?

The IRS allows final tax returns to be efiled, but it may fail if the Social Security Administration has locked the person's SSN. If this is the case, you will have to paper file the final income tax return.  Since you will be claiming a refund on behalf of the deceased individual, you will also need to complete Form 1310, (Statement of Person Claiming Refund Due a Deceased Taxpayer) and send that in with the tax return.  Please see the LINK below for more information on filing a Final tax return for a deceased individual.

I am trying to efile for my deceased mother. I have already filed the form 1310 with the IRS, and there is no indication that the Social Security has blocked her SSN.  How do I attach form 1310 to her 1040 and efile?

At what point in the process are you having trouble with the e-File and what is the message you are receiving?

During the Final Review I get the following message:

"IRS Rules Don't Allow E-filing of Your Federal Return

Why? Well, it looks like you have a tax situation in your federal return that makes it ineligible for e-filing.

Here are the details:

The taxpayer is deceased and the return shows a refund is due.  To e-file this return, Form 1310, Statement of Person Claiming Refund Due a Deceased Taxpayer must be completed, and Part I box C must be checked."

I have completed the Form 1310 and checked Part I Box B (as this is what applies) and that the 1310 and Certification has already been filed with the IRS.  TurboTax shows me the filled out form complete with the message on the bottom that the "Certificate Previously Filed" message.

There are no error messages in the Federal or State returns.

There are instructions I have tried that are inaccurate and never see the "Let's see if you need to file Form 1310 screen" which most instructions say I should see.
