Husband passed w/out a will. Former employer issued 1099-MISC for payroll funds 4 years later. Check made in his name, so I can't cash. Do I include with my return?

Do I include as income with my return even though I have not been able to cash the check yet?   The check is not in my name, it was made to the estate of his name with his SS#.  I do plan to cash it as soon as I get court approval.

if you talk to your bank officer and they know you (and maybe even if they don't), they could deposit this check for you.
