How to change turbo tax part time residency to non-resident for state filing of taxes

My wife and I purchased a home in Delaware in March of 2020 and changed our driver's license, vehicle registrations, and voter registration to Delaware.

All of these efforts were undertaking to claim Delaware as our state of residence.

However, Turbo Tax has established the state returns as follows, part-time resident for Virginia (for me), part-time resident for Maryland (my wife), and Part-time resident for Delaware (where we are claiming our residency with our actions as mentioned above).

On top of that Turbo Tax says I have to file married filing separately for Virginia?

We have recently ensured that our retirement accounts are not being garnished for taxes in either Maryland (for my wife) or Virginia (for me) as they were for some part of 2020.

This doesn't make sense and how can I change what Turbo Tax is wanting to do?

Since you moved to Delaware in March you must file a Part-Year resident return in Delaware and a Part-Year return in your prior state of residence.

 

If you need to correct: At the start of each state interview, you can change/correct the residence status.  You can edit and if needed delete and state returns you do not need.  The original entries for this is in the Personal Info section.  It asks if you lived in any other states or earned income in other states.

 

For Virginia: Filing Status 3 - Married, Filing a Separate Return:. If you and your spouse filed a joint federal return, but only one of you is a Virginia resident, the resident must use Filing Status 3.
