How should my husband and I file our taxes since my father is claiming both of us since be supported us this year?

Do we file a joint return or as married filing separately ? Since we are both dependents is my husband head of household even if my dad claims him?

Unless your husband lived with your father the  entire year and his gross income was less then $4,150 then  he cannot be claimed as a dependent.

Unless you are under age 24 and a full-time student you also cannot be claimed if your income is more then $4,150.

Neither of you can be claimed if you file a joint tax return.

Also HOH is for unmarried persons - married persons that lived together any time during the last half of the year cannot file HOH.

Your husband cannot claim head of household if someone else is claiming him. Make sure that you and your father review the rules for claiming dependents, to ensure he is eligible to claim you and your spouse.
