Head of household confusion

My boyfriend and I live together and have a son together. The house is In his name and he pays for more than half the bills. Is he able to claim head of household if I claim the baby? So he would file HOH without the baby and I would file single with the baby.

He has to claim a dependent (the baby) to qualify for HOH.

under the rules for claiming a dependent, there is a rule that applies when more than one person can claim them.  under your circumstances, either of you can claim because the support provided by a parent does enter into the determination. It would also appear the both of you meet all the other rules for who can claim. since either of you can claim the rule that applies is the parent who had the higher Adjusted Gross Income
