Form 8615 with divorced parents

Hello everyone,

 

I am 19 years old and have unearned income that requires me to file the form 8615. I acquired this unearned income through unemployment earnings(pandemic unemployment assistance). My parents are divorced, so when the form asks for "parents' qualified dividends smart worksheet" or "parents' schedule d" which parent do I use? I live most of the year with my mom, if that matters.

 

TL;DR: Which parent's information do I use to fill out form 8615 if my parents are divorced?

"If your parents were unmarried, treated as unmarried for federal income tax purposes, or separated by either a divorce or separate maintenance decree, enter the name and SSN of the parent with whom you resided for the greater part of the calendar year" (from i8615). As long as you are claimed as a dependent, Form 8615 needs to be filed.

Hello, and thanks for the reply!

 

Just to clarify, you mean I should use the schedule d and investment smart worksheet information(which is asked about on the form 8615) that corresponds with the parent I live with? The problem is, I don't think my mom received a schedule D form. She does not have investments or anything of that sort(or income).

JulianTaxQ  Then it is an easy form to fill out.

 

Since you are a dependent on your parent's tax return you have the option to use the information of the parent that claimed you or the parent you actually lived with the majority of the year.  But you use the information from that parent's return on your return.  If their schedule D is all zeroes, so be it.
