Filing Form W-7 with my Dual Status Return

Hi! I am filing a dual status return for 2024 with a Form 1040 and Form 1040NR. I would like to apply for an ITIN for my child with this return? Can I file a W-7 and accompanying documents with this dual status return? Someone informed me that a W-7 can only be filed with a Form 1040 alone (i.e. no dual status return). This is not feasible for me and I do not intend to claim any tax benefits or credits for my son for the 2024 tax year. Please let me know if there is any chance I can file the W-7 with my dual status return. Thanks.

You can file a W-7 anytime without attaching it to a tax return as a stand alone form.  You can file it with any tax return that you file as well.

 

However, you should know, a child with an ITIN is not considered a qualifying child for a child tax credit or the earned income credit.
