Do you have to report a check from former employer for a waiting time penalty wages claim filed through the labor department. I only received check not a 1099

I did report it just not I’m now sure I did it correctly

Yes, you would report the penalty amount as Miscellaneous income.  It should be on your 1040 Line 8.

@MaryK4 Thank you for your reply. Ok so if I added it to income but not line 8 will I have to amend?

That's okay if the Miscellaneous Income is not on Line 8, as long as it is included in Income on your return. Since you didn't receive any particular tax document to report it, it can be added in various ways.  Here's one way:

 

  • On the Income topics page, scroll all the way down to Miscellaneous 1099-A, 1099-C
  • On the next page, scroll all the way down to Other Reportable Income
  • On the next page, say Yes to Any Other Taxable Income
  • On the next page, enter a Description and Amount
