Do I need to file 1040NR and 1040 both?

Hello altruists, 

 

I was a nonresident alien on F1 Student visa until February 13, 2024. On February 13th, I received my Green Card and became a lawful permanent resident (LPR). I am working at a University and received a W-2 and 1042-S form as I claimed a Tax Tready benefit in 2024. My questions are:

 

(1) Do I need to file both 1040 and 1040NR when filing taxes? 

(2) If I am filing only 1040, then can I show my 1042-S income as "Other Income"? No online filing tools have an option for 1042-S since the tax treaty benefit is specifically for nonresidents.

Yes.  You would be considered a dual status resident for 2024, so you would need to file a 1040NR for the time you were a Non-Resident and a 1040 for the time you were a resident.

 

As a dual status resident, you cannot only file the 1040. 

How should I file my taxes as a dual-status alien?
