daughter became a resident on her own in another state and we as her parents can NOT claim her now

Daughter moved to Montana from Illinois and in order to become a resident in Montana she had to become a resident for in state tuition. We can NOT claim her...how will this affect HER taxes when she is on her own now

Hi, tonihunter89,

 

I am assuming that the reason your daughter can't be claimed is that she's 19 or over (or 24 or over if she's a full time student and/or she's providing more than 1/2 her own support.  Here's a great article to help her prepare for filing her first return.

 

It's important to note that if she cannot be your dependent, she also may not even have a federal/state filing requirement (although I suspect from your message you want her to file anyway, either to claim a refund or provide a residency paper trail).

 

Here is information on federal tax brackets for 2023 at the federal level (note, it's on taxable income, after the standard or itemized deduction).

 

As a part year Illinois resident, this is her filing requirement:

 

  • a part-year resident , you must file Form IL-1040 and Schedule NR, Nonresident and Part-Year Resident Computation of Illinois Tax, if
    • you earned income from any source while you were a resident,
    • you earned income from Illinois sources while you were not a resident, or
    • you want a refund of any Illinois Income Tax withheld.

Here is the filing requirement for Montana:

You must file a Montana Individual Income Tax return if:

  • You were a resident or part-year resident of Montana, or
  • You were a nonresident who received Montana source income, and
  • Your federal gross income, excluding unemployment compensation, meets the Montana filing threshold.

You should file a return if you had Montana tax withheld from your paycheck or if you paid estimated income tax, even if you aren't required to file a return.
