If your child did not live with his father for more than half the year (assuming he is under 19), then he cannot claim him. You can file and claim your son, but you will need to mail the return to the IRS. The IRS will contact both of you to determine who is entitled to claim your son.

He didn’t live with him any , I already filed my taxes due to the fact he had already filed & I didn’t know what to do . We both filed so now I’m stuck I’m not sure where to go from now being that he’s saying he isn’t giving my son his money

As noted , if you both claimed the child , the IRS will straighten it oit

However, PaulaM, it appears to further state there was an agreement in place for the father to claim in return for giving the financial benefit to the children

Sounds like more of a legal dilemma than a tax one ??????
