Checking the fees for services. i am not getting a refund on federal, so why am I charged 40.

If you use the software you pay for it.  Your fee is not determined by whether you get an income tax refund--you could owe the IRS and still have to pay TurboTax for using this software.  

But....do you qualify to use Free File instead?

If you are just filing now the fee for Deluxe is $60 and state is another $50.  You might just be seeing the $40 Pay with Refund charge to have all the fees deducted from your refund.  So it might be actually 60+50+40
