Cant file as head of household with my non dependent child

I have a non dependent child (makes more than $4,300, is over 24) and living with me for the year.  I am paying for the majority of the household expenses and should be able to claim head of household with a qualifying dependent.  TT however keeps switching my filing status to single. Ive read this is a known bug back in January. Is there a work around? How can this be reported to TT if not.

You may still qualify for head of household filing status even though you aren't entitled to claim your child as a dependent, if you meet the following requirements:

  1. You're not married, or you’re considered unmarried on the last day of the year.
  2. You paid more than half of the cost of keeping up a home, that was your home and the main home of your child for more than one-half of the year.
  3. Your child is your qualifying child for purposes other than the dependency exemption and the child tax credit.

To claim HOH with a 24 year old person, that person MUST be your dependent.

 

The section you quote only applies to divorced or separated parents who live apart and the only reason the child is not claimed is because the non-custodial parent is claiming the minor child as a dependent.   The parent must be ABLE to claim the child even if they do not.

 

Look more closely at that publication. 

 

You cannot claim your relative because of age and income.   You are not ABLE to claim.
