Can you e-file for "Married Filing Jointly with a nonresident alien spouse"?

hi, wondering if i can e-file with my nonresident alien spouse if she already has her ITIN number.

Not If it is the first year you are filing jointly, as you need to attach a statement per the article you reference stating that you both agree to be taxed as US citizens for tax purposes. Since you need to attach the letter, you will have to mail your tax return in.
