Can we file jointly & get EIC & child tax credit if spouse has an it in but no ssn? Or can i just file head of household & STILL get both credits?"

Last year i was single with 1 child & received EIC and child tax credit. Now im married. My child & i are citizens but my spouse doesn't have a ssn, only a ITIN. He is also working receiving U.S income. Can we file jointly & get EIC & child tax credut again this year? Or can i just file head of household regardless of being married & still get both credits?"

I'm afraid your husband must have a Social Security number to qualify your family for the earned income credit.  Since you are married, you cannot claim head of household status unless you and your husband lived apart for at least the last six months of 2015.  Please read on for more information.
