Can the IRS garnish my tax return if i don't have insurance

If you mean take part of a refund (a tax return is the document that you file with the IRS that shows your income, deduction, taxes owed, and taxes paid) because you owe a penalty for lack of health insurance coverage, yes they can offset your tax refund by the amount of the penalty.
