Can someone help me out with my ITIN? I just got my spouse's ITIN last year and we are finally using it this year and we are prompted that it's expired.

We got married on 2022, we got our ITIN via H&R Block in April 2023, and now it's prompted that it's expired. Please help

If you know it is active, ignore the message - it won't prevent e-filing.

Will there be any issues If I submit it like that?

 

Another question, let's say (Hypothetically) that for some reason the ITIN is expired. Will I get some penalty by the IRS or something? Any repercussions?

No, there is no penalty.   You have three consecutive years to use your ITIN at least once on a federal tax return—as a filer or as a dependent—before it expires due to non-use.

 

You can renew your ITIN for free by filling out a Form W-7 and submitting the required documentation.  Your W-7 application can be submitted via mail to the IRS, or you can call and make an appointment at a designated IRS Taxpayer Assistance Center.

 

Renew your ITIN if necessary. If you do not renew an expiring or expired ITIN, the IRS can still accept your tax return, but it may delay processing it, which can impact when you get your tax refund. Expiration can also delay tax credits owed to you, such as the Child Tax Credit and the American Opportunity Tax Credit
