Can my bf claim my niece i have custody of on his taxes if he supports her

Your boyfriend can claim her only if you are not required to file a tax return and he meets all the following rules as a Qualifying Relative:

  • Gross Income: She made less than $4,200 in 2019.
  • Total Support: He provided more than half of the total support for the year. - See Support Test
  • Member of Household or Relationship: He must have lived with her all year.
  • She is not claimed by another taxpayer.

 If you are required to file a 2019 tax return, he cannot claim her even though you forgo your right to claim her.
