Can I not submit return until I get judges ruling?

Bankruptcy judge determining if my student loans were discharged not can I get an extension from filing so I don't give up my return?

If you are now in a pending bankruptcy proceeding, you really should ask your attorney this question. I can tell you that, from a tax perspective only, you can apply for and receive an automatic six month extension of time to file your tax return. This is not an extension of time to pay, so if you owe taxes, you must make payment at the time you request the extension or not later than April 15, 2019. 

My concern is that many bankruptcy judges and US Trustees are meticulous about timely filing of tax returns by debtors under the supervision of the Court. I would not want to advise you to file an extension that might result in you being penalized by having your bankruptcy petition dismissed.
