Can I file my two children if I am the non custodial parent but the custodial parent does not work and can not file taxes?

The kids mother lives alone with the kids so there is no one else qualified to carry the kids. So given this info, I'm assuming I would still need her permission or for her to fill out that form. So can you just not file children?

as long as you are there parent and they live with you more than 6 months a year you can clame them as dependents but you need to have her permission if she found out youclamed them without her permission it could cause your tax refund to be rejected
