Can I e-file this year if a fraudulent returned was filed against me in the past?

Possibly.  If you reported the identity theft to the IRS and they issued an IP PIN (6 digit identity protection PIN, different from the 5 digit e-filing PIN) then you need to include the IP PIN or e-filing will be blocked.  (If you never reported the problem using form 14309-T, you probably should.)

If you don't have an IP-PIN you can try regular e-filing, I don't know of any automatic block.  But if it doesn't work, you can print and mail your return. (Don't forget to also mail your state return.)
