Can I claim my daughter as a dependent if she has already claimed herself

She is 22, a full time student, and lives at home full time.  She has already claimed herself as a dependent, and already filed her taxes.

If your daughter meets all of the requirements to be claimed as a dependent on your tax return, and claimed herself, she will need to amend her return and change her answer to the question that asks if she can be claimed by someone else as a dependent to indicate that she can be claimed by someone else as a dependent. To determine if you were eligible to claim your daughter as a dependent, please see the following rules:

There are 5 test that will qualify a child as a dependent as follows:

  • Relationship: Must be your child, adopted child, foster-child, brother or sister, or a descendant of one of these(grand or nephew).
  • Residence: Must have the same residence for more than half the year.
  • Age: Must be under age 19 or under 24 and a full-time student for at least 5 months. They can be any age if they are totally and permanently disabled.
  • Support: Must not have provided more than half of their own support during the year.
  • Joint Support: The child cannot file a joint return for the year.

 

There are 4 tests that will qualify a relative as a dependent as follows:

  • They are not the “qualifying child” of another taxpayer or your “qualifying child”.
  • Gross Income: Dependent earns less than $4,000 in 2015.
  • Total Support: You provide more than half of the total support for the year.
  • Member of Household or Relationship: The person must live with you all year as a member of your household or be one of the relatives that doesn’t have to live with you see IRS Publication 501for a list of qualifying relatives.


Note: That if your daughter doesn't amend her taxes to reflect that she can be claimed as a dependent by someone else, you cannot claim her on your tax return as a dependent. Your return will be rejected.


Per the IRS: If you can be claimed as a dependent on another person’s tax return, you cannot claim a personal exemption for yourself (because then the IRS would essentially be counting you twice). This applies even if the other taxpayer does not actually claim you as a dependent on their return. To amend a return,  you will need to wait for the tax return to be accepted, and any refund due to be paid before you amend your return.   Please keep in mind that an amended return, Form 1040X, can only be printed and mailed to the IRS, it cannot be e-filed, but you can prepare your 1040X in TurboTax and print it for filing.

Just becuase your daughter already claimed herself DOES NOT mean you cannot claim her.  You can and should.  Ity means you can't e-file.  Prepare a paper return, attach W-2s, sign it and mail it.

In response to above (BobB7) your daughter will need to amend her return otherwise yours will just be kicked back!

If they try to efile it will "just be kicked back", but if you file a paper return it will not be.  Instead, the IRS will determine who is in the right.  BobB7
