Almost March and still haven't received W2 from former employer. When should I file?

I have already mailed a form asking to be connect to an IRS Local Taxpayer Advocate. But that can take weeks or over a month. Should I wait until I hear back from them, or can I go ahead and file online? I did not receive any paystubs either from this employer either, just checks. Also running into the issue that he did not pay me overtime at overtime rates, and what he did pay for overtime was under the table, but I will report the income that I got.

You can go ahead and mail your return in if you attach form 4852.

 

You can complete form 4852 Substitute for Form W-2 to use as your W-2. If you get the actual W-2 form later, you can amend your return to correct it.
