1099 C

My spouse passed away in October 2016. In the beginning of 2017, a credit card in his name only, was cancelled, closed and "forgiven". This month, 2020, I received a 1099 C for the cancellation of debt, in his name only. I am in a community property state, am I responsible to file this for 2020? There was no estate when he passed and things have changed the past years that this will have an ill effect on my side.

If he had an estate, the estate would be responsible for paying the tax on the income.

 

In the absence of an estate, you have nothing to report.

 

It doesn’t matter why the bank waited so long to send a Form 1099-C. Your name is not on the Form 1099-C, and you are not filing a joint return with your husband at this point.

 

You are not required to report the canceled debt on your own return, even if you reside in a Community Property State.
