PREMIUM TAX CREDIT FOR UNEMPLOYED IN 2022

In 2021, near the top of Form 8962, there was a box to check "if you or spouse were approved to  or received unemployment compensation in any week beginning in 2021".

If so, this capped you at 133% above the poverty line.

But this box is not on the 2022 Form 8962.  Is that a glitch?  I cannot find one answer on this on any site. We actually have $20K less income, sporadic unemployment, but because there is no box to check this year like last year, Turbo Tax is stating that we must repay the advanced premium tax credit back to the tune of $5K...

Any one have intel on this?  Thanks.

Part of legislative relief for tax year 2021 was an exemption of some unemployment benefits from federal income tax. That was not renewed for 2022, so it reverted to the same as 2020, where benefits are taxed.

This is a link to  IRS Publication 525, Taxable and Nontaxable Income. It discusses unemployment compensation on pages 29 and 30.

Thank you, Teresa.  That much I understood in regards to the $10,200 of UI being deducted from federal tax.   Are you saying that the same act affected form 8862 in regards to unemployment?

Yes, for tax year 2022, unemployment benefits count toward household income for purposes of the Premium Tax Credit
