OPT-O1-H1B year US-China tax treaty Article 20

Hello, I changed my work visa from OPT to O-1 on February 01, 2022, and then changed to H-1b on November, 2022. Can I still claim the $5000 exemption based on "US-China tax treaty Article 20" for 2022? My income in January, 2022 was above 5000.
