My child was claimed by another parent that does not have the legal right to do so. How can I assure that I get that money returned to me?

If the other parent already e-filed, you will need to print and mail your tax return.  Include the dependent on your return as well as any child tax credits.

The IRS will send letters to both parents, asking for details on the child's living arrangements, etc. They will decide who is entitled and adjust the taxes accordingly.
