Is my wife's car mine? I use her car to drive Uber part-time. Car/payment is in her name only, but I make her car payments from Uber income. Married Filing separately.

We both consider her car "ours".  We both pay repair/maintenance costs, though I pay her car payment.  Wife uses her car for personal use only.  Can I indicate that I own the car?

Why are you filing as Married Filing separately (MFS)?

We've been MFS for several years due to my previous business & I only can claim $ 2500 for child-care FSA , & but will be filing jointly for 2018 to get $ 5000 FSA.

Yes, you can mark that you own the car.  Just be sure to keep track of your business use of the vehicle and your and your wife's personal use of the vehicle.  Only the portion you used for business (Uber) gets deducted.

Thanks for your response! Yes I tracked all my Uber mileage.  Is it necessary to track the personal mileage for each of us as well?

You are welcome.  Not your personal miles and your wife's personal miles each separately.  You need to know the total number of miles (driven in 2017) and the total number of business miles so that TT can calculate the correct  % of business usage and proper depreciation.
