If I am divorced and do not live in the home but my name is still on the mortgage which my ex husband pays can I use the 1098 form on my taxes?

No, if you are divorced, not living in the home and your ex-husband pays the mortgage, you should not include the1098 on your taxes.

You would only include the Form 1098 on your Tax Return if you are the one making the mortgage payments.
