I pay the mortgage on my house, the mortgage is in my ex-husbands name because my house was almost foreclosed, we did a modification but because of my income I wasn't able to get my own mortgage, therefore until I'm able to get a mortgage under my name the mortgage stays under his name as the borrower, which means the 1098 form is under his name, how do I file this form if it's under his social security...he does not contribute anything towards the house, I do it all!
As long as you are a legal owner of the property, the person who makes the mortgage payments is the one eligible to claim mortgage interest and property taxes. If you both pay, you would split it between the two of you.
When you enter it into TurboTax, you should mark the box for My name is not on the 1098. TurboTax will ask follow-up information about the person who the 1098 was issued to.
