I live in a community property state. My name is not on the mortgage. Can I deduct mortgage payments I make to my husband whose name is on the mortgage?

It depends on the state. Did he acquire the house during your marriage? If so, you would generally be able to claim half the house.

 

But if you married after he bought the house, then you would have to check the laws of your state to see if shared property like a house eventually becomes community property.

Thanks for this info. He bought the house before we got married. We live in Wisconsin so I’ll have to see what the rules are there
