My wife and I have never had an HSA or any of the options covered in Form 8853. Smart Check finds an estimated entry in "Form 8889-S: Original", but I am unable to find that specific form nor an estimated entry in Form 8889-S that does exist. Also, don't understand why we both even have an 8889. In EasyStep, when I select Update for "1099-SA, HSA, MSA" and select "None of the above" and "no" for each of us, we still get 8889 forms. Both forms have identical information (0 in Box 2) and neither are estimated. No error exists for 8889-T. On 8889-S, I've reentered 0 multiple times and have toggled between the estimated options.
Take a look at any W-2s that have been entered for the spouse shown on the tax return. Check box 12 to be sure that there is not an entry with the letter code 'W' that has been entered by mistake. Code W in box 12 indicates that a contribution was made to a Health Savings Account and it will trigger Form 8889-S (or Form 8889-T for the primary taxpayer) to be added to the tax return.
If you do find and correct any information entered in the W-2 and the error persists, then go to the HSA section of your return and indicate that the spouse does have an HSA. Go through the section and be sure to delete any entries that you still see there. Then go back and indicate that the spouse does not have an HSA.
Hopefully, that will clear the error condition.
