Dependent Eligibility for Third stimulus payment:Rebate Recovery Credit

Re 2020 tax year filing: Must a 17 year old high school student who otherwise meets the definition of a “dependent” qualifying child be claimed by parents as a dependent? Student filed independently in 2019 and will need to do so in 2020. Since parents didn’t qualify for third stimulus check due to income, will student be able to claim $1400 stimulus check as a recovery credit on her 2020 taxes so long as her parents did not claim her as their dependent on parents 2020 tax filing?

If the student is your dependent, you can claim her or not. 

She can file her own return but only as a dependent of someone else. 

Just because you don't claim her does not mean she is not your dependent. 

 

If she is NOT your dependent, she will be eligible for a stimulus payment.
