Can dad use the dependant care fsa to pay for 1/2 of childcare for mom to work if she claims all deductions?

Both have insurance on child.

Only the custodial parent can claim the childcare credit.  You do not say if you are a married, never-married, or divorced couple.  Telling us that would help.
