As a live in IHSS provider for my son with severe autism, can I claim dependent care credit for my young daughter's summer camps?

Due to my son's behavior, I find it difficult to care for him and my young daughter, so I enroll her in summer camp.

The income that you make as a live-in IHSS provider is exempt so you wouldn't qualify for the Child and Dependent Care Credit unless you have other earned income.

There are certain qualifications that you must meet to be eligible for this credit:

  • Must have  earned income (If you are Married Filing Jointly there are exceptions)
  • You must have paid for caregiving expenses to work or look for work
  • The care you paid for was for a qualifying person
  • You aren't using the Married Filing Separately Filing Status
  • You provide the caregiver's name, address, Social Security Number, or taxpayer ID number.
