W-2 has 2 states

My daughter lives in and works in Massachusetts but uses my NY address for her mailing address. Her employer used my NY address so she received two w-2. The w-2 for NY show the wages she earned even though they were earned in Massachusetts but no taxes were withheld. Does she have to file and pay NYS taxes even though she didn't live in NY? And how would add the NY return for her? I can't check the box for earned income in another state because she didn't earn this income in NY and I can't select part time resident because she didn't live here at all during the year.  I'm guessing the solution is having her employer correct her address and get an updated w-2. Any other options?

It doesn't matter what her mailing address is. If she doesn't live or work in New York, she doesn't need to pay New York income taxes. In Turbo Tax, she may use your address as a mailing address but where it asks "tell us the state you live in." She would declare this as Massachusetts. She will not need to file a NYS return.

But what about the second w-2 that has NY in box 15 and wages in Box 16?

I finished the return but it's not allowing E-File for Massachusetts state return. It says the reason is "Resident returns with other state source income and only reporting Massachusetts source income from form w-2 box 16".

So my options now:

(1) Mail in the Massachusetts return or

(2) Remove the second state info from the w-2 on the program or

(3) Have my daughter's employers change her address and get a corrected w-2.....unless you have another idea?

One of the W2s received should be checked as "corrected"? If not, I would definitely suggest that you contact her employer and inquire as to why the 2 W2s as well as make sure they correct this error unless as I mentioned one W2 might have "corrected" checked at the top of it.

 

Clearly, there has been a mistake on their part and DaveF1006 is correct in that no NY return need be filed, only the MA return. Don't forget, as he states above, to have her put your address as the mailing address and her MA info as her residence.
