My son is a full time student in Virginia. He is a full time resident in North Carolina. Does he have to file taxes for both states as he has a W2 from Virginia?

Again, not sure if my son has to file a non-resident state tax form for Virginia if he is a full time student there and worked there over the summer. He is a full time resident of NC and a dependent on our taxes.

Yes. If he is a permanent resident of NC but was in VA on a temporary basis (going to school is considered a temporary basis) and earned income in VA, then he will need to file a VA nonresident state income tax return (for his VA source income only - his VA wages). He will also need to file a NC resident state tax return (for all income from all sources including VA wages). He will get a state income tax credit in NC for any VA state income taxes that he paid on his nonresident VA state income tax return.

He will want to work on his nonresident VA state income tax return first. He will then take a tax credit from his nonresident VA state income taxes on his resident NC state income tax return. (Please note that he will only get a tax credit for his VA state income taxes up to the amount of NC state income taxes that would have been paid if the income was earned in NC).  The credit for taxes paid to another state section will be at the end of his residence state's interview process.

Just follow the TurboTax guide when working on your states (remembering to do his nonresident state return first) and TurboTax will do all the calculations and credits to your resident states return
