Military Spouse

I'm a military spouse living overseas where my spouse is stationed on active duty until 2024. Our state of legal residence is Oklahoma. I am licensed in Arizona for my profession and that is where the company I work for is. Arizona took state taxes out of my W2. Can I get my Arizona state taxes refunded to me and then file as a resident of Oklahoma? Do I even need to file state taxes in Oklahoma?

Yes, if you claim the Military Spouse Residency Relief Act (MSRRA) then you can keep Oklahoma as your state of legal residence and only pay taxes to Oklahoma.

 

You should be able to file an Arizona tax return claiming MSRRA and get a refund on the tax withholdings. 

 

Yes, you will need to file an Oklahoma tax return to report your income.
