Married filing jointly but spouse is a full time student, resident of another state with little income

Married filing jointly but spouse is a full time student and resident of another state NJ. Spouse has very little income, does spouse need to file taxes in NJ?

Not if he made $10,000 or less. New Jersey allows married couples to file separately if one person is resident and the other is a nonresident so his threshold would be $10,000.

 

He had had NJ state tax withheld, he may want to file a return to get a refund.
