If I got a settlement for back wages earned in California but now I live in Georgia, do I claim it as income earned in California or Georgia?

I have to file a California state tax return because the settlement check had California state tax withheld and I want to get it refunded.

You will have to file a CA tax return and report this income as the settlement was for back wages earned in CA.

Half of the settlement was put on a W-2 and had taxes withdrawn. The other half was put on a 1099misc. Do I only have to claim the W-2 in California and claim the 1099 in Georgia?

It depends.

 

Do you know what the state source is for the 1099 form? 

 

If it is from California sources, you will need to pick up the income on your California return.  You will be able to claim a credit in Georgia for any income taxed in both California and Georgia to ensure the income is not taxed twice.

 

If it is from Georgia, then you would report it as being from Georgia sources.
