I received a New York Partner's Schedule K-1. I am not a resident. The gain is less than 800 dollars (I've no other NY earnings) do I need to file a NY State tax return?

No, you do not need to file a NY return as a nonresident if your NY income is less than your NY standard deduction. If you only have $800 of income from NY, you would not need to file a NY return.

Based on the attached instructions and the limited facts, it does not appear you need to file a New York IT-203.  See the "Who Must File" section.
