I live in Ohio but work in Michigan, my W-2 box 15 shows OH, do I still have to file Michigan state tax?

Unless you had Michigan tax withheld or non-wage MI income (e.g. rental property), you do not have to file a MI tax return. OH & MI are reciprocal states, meaning you can work in MI and not have to file a MI tax return.

Started 2021 living and working in Ohio for Kohl’s.

Mid-May, switched from my Kohl’s in Ohio to a Kohl’s in Michigan, nearer to my Mom, who had been diagnosed with cancer. Still living in Ohio.

 

August 1 my husband and I moved up to a new apartment in Michigan. So ended up 2021 working and living in Michigan. However, come the end of the year, seems that Kohl’s didn’t update state taxes, so how do I rectify this? Chances are I don’t owe Ohio or Michigan anything, but I need to know how to square this.

Ohio and Michigan have a "Reciprocal Agreement" where the employee only pays State Tax to the state in which they live.   

You should let your employer know which state is your resident state and that is the state tax they should withhold for you. 

 

If you live in Ohio, you only pay Ohio state tax on income earned in Michigan and/or Ohio.

If you live in Michigan, you only pay Michigan state tax on income earned in Michigan and/or Ohio.

 

If state tax is withheld for the wrong state, a non-resident (or in your case part-year resident), state return needs to be filed to get the tax paid erroneously refunded. 

 

There is a form you can give your employer so they withhold tax for the correct state

 

NOTE: If you work in a CITY or COUNTY that taxes, that tax needs to be paid. The agreement is only between the States. 

 

Find the form you need.
