California taxable wages

My daughter began the year living and working in California, but moved to Colorado during the year.  She continued to work for the same company for all of 2020 and was paid from the California office but worked remotely in Colorado.  In November she bought a home in Colorado.  Are all of her wages considered California income, or can she pro-rate them between California and Colorado?

It depends. When determining the filing requirements and her residency status for 2020, the circumstances related to COVID-19 must be considered. 

 

Her actions based on COVID-19 may establish facts and circumstances that support a determination of whether she was in (or out) of California for other than a temporary or transitory purpose. Since she bought a home in Colorado, it seems as if this is a permanent move for your daughter and not temporary due to Covid-19.

 

If this assumption is correct, then she did move permanently and change her domicile. She would then file a part-year return for California and a pat-year return for Colorado. She would pro-rate her income based on what percentage of her wages were earned in California and how much of her wages were earned in Colorado.
