Where do I file my french retirement benefits which are not taxable in the US due to the tax treaty?

You should complete a substitute form 1099-R entry in TurboTax to report the retirement income by using these menu tabs:

  1. Income and expenses
  2. Retirement Plans and Social Security
  3. IRA, 401(k), Pension Plans(1099-R)
  4. Choose the I need to prepare a substitute 1099-R  option when you see it

After you enter your substitute 1099-R form, use these menu tabs to exclude the income from taxation:

  1. Income and expenses
  2. Less common income
  3. Miscellaneous income, 1099-A, 1099-C
  4. Other reportable income
  5. Enter a description of the treaty and the amount as a negative number

So, you will enter the income and then cancel it out with a negative entry.

 

You should complete and attach form 8833 to your return, which you must mail it, to disclose the treaty. This form is not available in TurboTax, but you can complete it online by using this link:
