What can I do? I have a subcontractor that will not provide the EIN or his social security for the job we paid him in order to create the 1099?

Going forward, you should ask for Form W-9 BEFORE signing a contract. 

 

For now, you can follow the directions listed in this linked answer, but technically the forms should have been submitted to the IRS by January 31, 2025.

 

Keep a copy of the invoice the contractor sent you (as well as any contact information you have such as a business card) and the request for EIN (or W-9) you sent to the contractor.
