My mother in-law passed away. Her private healthcare worker requested a 1099 form. How do I create one?

I checked the IRS website and it states that a penalty would be applied because the from was not filed before 1/31/23.

No.  Your MIL was not running a business and did not need to provide a 1099 to the care provider.  The care provider can report their income on a tax return even without a 1099.
