If I am separated from my husband and in our settlement agreement it states that he is responsible for the taxes on his IRA withdraws, should I file seperatley?

If you are separated from your husband, your choice is still to file jointly or separately.  This will be a choice until you are legally divorced.  If you file separate, you will need to include his SSN on your return, and he will have to include yours on his.
