Can I go about claiming unemployment I have repaid that was under a judgement with penalties? I have been paying since 2016.

I have been making payments since 2016, there is no running breakdown of what portion I am paying, penalties or actual compensation,  just payments made versus total left.

The penalty portion of your payments are not deductible, so it should not be included. The state unemployment agency should have sent you a 1099G form, illustrating the principal amount repaid.  If not, you can log into the state site used when you were collecting the unemployment and print out your 1099G there. If that is not an option, you will have to contact your state unemployment department and request the form.
