Dell Technologies Class V Stock Litigation Payment

On January 29, 2024, I received a litigation payment for the December 28, 2018 conversion of Dell Class V common stock (NYSE: “DVMT”) to Dell stock.  The payment is included as short term (ordinary income) transaction on my Fidelity 1099 with no cost basis.  All of the DVMT stock and now Dell stock have been held long term (2006 - 2016).  Should this be considered a long term transaction instead of short term?

Yes, you can adjust the holding period to long term and include your cost basis to reduce the gain.
