Will I be eligible for EIC if I'm a part-time student? My college considers part time when it's less than 12 credits and I'm taking less than that per semester (16 weeks)

I took two semesters (fall and spring last year) which have 16 weeks each and I took less than 12 credits, which is considered part time in my college. Will that make me eligible for EIC? I'm 22.

Can your parents claim you as a dependent?

For 2021 only, being a part-time student will not exclude you from claiming the EIC. But you have to meet all the other requirements for the EIC, including not being a dependent. You cannot claim the EIC if your parents, or anyone else, could claim you as a dependent, whether or not they actually claim you.


The lowering of the minimum age for EIC is for 2021 only. For any other year you must be at least 25 years old to claim the EIC.
